This End User License Agreement ("Agreement") is a legal agreement between you ("You" or "Your") and Time Stop Art ("We," "Us," or "Our") for the mobile game application "Zip Zip Jump" ("App"). By downloading, installing, accessing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not use the App.
We grant You a limited, non-exclusive, non-transferable, revocable license to use the App for Your personal, non-commercial use on a single device owned or controlled by You. This license does not allow You to use the App on any device that You do not own or control.
The App, including all its content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio), are owned by Time Stop Art, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You agree not to use the App to:
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to the practices described in our Privacy Policy.
The App is provided "as is" and "as available," without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by law, in no event will we, our affiliates, or our licensors be liable for any indirect, special, incidental, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) Your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use, or alteration of Your transmissions or content.
We reserve the right, at our sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, You agree to be bound by the revised terms.
We may terminate or suspend Your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach this Agreement. Upon termination, Your right to use the App will immediately cease.
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which our company is established, without regard to its conflict of law provisions.
